THE RULES OF THE CHINA THOROUGHBRED REGISTRATION AND MANAGEMENT Chapter 1 General Rules

Article 1. (Aim)

Being ratified by the Ministry of Agriculture, the Ministry of Civil Affairs of the P.R.C., China Stud Book Committee (referred to as “CSBC” hereafter) is a sole registration and management authority responsible for international exchange and registration of the Thoroughbred in China. 

“The Rules of the China Thoroughbred Registration and Management” (referred to as the “Rules”) are formulated in keeping with the requirements of International Stud Book Committee (ISBC) and relevant Chinese Livestock Law. The Rules are made to ensure the accuracy, integrality, continuance and legitimacy of the registration as also protect the interests and property right of owners, breeders and users including enterprises and individuals. 

 

Article 2. (Terms) 

1. “Registration” shall mean the registration of the pedigree, sex, color, markings of a horse and the facts arising in the course of its use in the official records and the Chinese Stud Book. 

2. “Foal Registration” shall mean the registration of the pedigree, sex, color, markings, breeder, owner of a horse that is born in China in the official records and Chinese Stud Book. 

3. “Breeding Registration” shall mean the registration of the pedigree, sex, color, markings, owner of a horse that is to be used for breeding in the official records and the Chinese Stud Book. 

4. “Identification” shall mean the confirming of a horse’s identity by checking the sex, color, markings of the body (brand, white hair, whorl, etc.), DNA testing, and document of detailed description, etc. 

5. “Foal imported in uterus” shall mean a foal in the uterus imported along with its dam and born in China. 

6. “Breeder” shall mean the person, group of persons or legal entity (including a company, partnership, etc.) that owns or is the lessee of the dam when the foal dropped. 

7. “Owner” shall mean the person who has acquired the right to dispose the horse by breeding, purchase, exchange, donation, or inheritance. 

8. “Parentage Validation” is the validation of a foal’s parentage by comparing the DNA profile of the foal with that of its sire and dam. If the results show the foal’s DNA profile to be compatible with both of its sire and dam, the foal is said to be “Parentage Validation”. If the results show exclusion, the foal isn’t provided “Parentage Validation” and such horse cannot be registered unless the owner proposes a possible change in pedigree which can proven and the parentage validation of the foal in question shows qualification. 

9. “Natural Mating” shall mean that the broodmare and stallion breed by natural methods, not by artificial insemination, embryo transfer or transplant, Cloning or any other form of genetic manipulation.

  1. “Brand” shall mean branding horses by appliance of brand. 

  2. “CHINESE STUD BOOK” is a book issued periodically and containing breeding 

results of Thoroughbreds in China. 

12. “Foreign stud book authorities” shall mean foreign Thoroughbred registration authorities duly recognized by ISBC. 

 

Chapter 2 Registration Rules 

Article 3. (Eligibility) 

  1. Only Thoroughbred horses are eligible for registration. 

  2. Thoroughbred is a horse which is record in a Thoroughbred Stud Book approved by 

the ISBC at the time of its official recording. 

3. Thoroughbred must be a product of a mating between a sire and a dam, both of which are recorded in an approved Thoroughbred Stud Book or either or both must have been promoted from a Non-Thoroughbred Register under the terms set out in the Article 13 of International Agreement on Breeding, Racing and Wagering. 

4. Thoroughbred must be the result of a stallion’s mating with a mare which is the physical mounting of a mare by stallion with intromission of the penis and ejaculation of semen into the reproductive tract. 

5. A natural gestation must take place in, and deliver must be from, the body of the same mare in which the foal was conceived. Any foal resulting from or produced by the process of Artificial Insemination, Embryo Transfer or Transplant, Cloning or any other form of genetic manipulation not herein specified, shall not be eligible for recording in a Chinese Stud Book. 

 

Article 4. (Classification of registration) 

Registration includes Foal Registration, Naming Registration, Breeding Registration. 

 

Article 5. (Registration applicants) 

1. The applicant of registration of a horse shall be its current owner or legally designated procurators. 

2. In the case of the corporate owner or the group owner (including ownership shared by more than one owner) for a horse, the representative of the corporate or the group becomes the applicant. The evident documents including the name of the corporate or the group and detailed information should be submitted along with the application. 

 

Article 6. (Inspection) 

  1. Inspections necessary to register a horse are carried out by registration inspectors. 

  2. Detailed matters regarding the appointment of registration inspectors and the 

installation of inspection committee shall be decided by the CSBC.

Article 7. (Cooperation for inspection) 

The owner of a horse to be inspected shall cooperate in the inspection required by Article 18, Article 25, Article 31 and Article 32. 

 

Article 8. (Disqualification) 

Any horse that falls under any one of the following categories is not eligible for registration. 

1. Any foal produced by unnatural methods such as artificial insemination, embryo transfer or transplant, cloning or any other form of genetic manipulation not herein specified. 

2. Any foal whose birth has not been recorded in the Return of Mares of its dam under 27 1 (2). 

3. Any foal that has been found to be disqualified as an offspring of the reported parents by DNA testing. 

4. Any foal that has been found to be disqualified as an offspring of the reported parents by applying the principles of coat-color inheritance. 

  1. Any foal whose sex cannot be determined. 

  2. Any foal whose gestation period is abnormal. 

  3. Other horses which have been recognized as disqualified for registration. 

  4. Modification of the heritable genome of a prospective or registered Thoroughbred, 

during its conception, gestation or at any stage thereafter in its existence, will result in that horse forfeiting its status as a Thoroughbred. 

 

Article 9. (Rejection or revocation of registration) 

1. Registration may be rejected in any of the following cases. 

(1) If an applicant refuses to cooperate in inspection or to provide blood samples for the DNA testing 

(2) If any falsehood or wrongdoing is found in application 

2. Registration is revoked in any of the following cases. 

  1. (1)  If a horse is found to have been registered through falsehood or wrongdoing 

  2. (2)  If a horse falls into any one of the categories of Article 8, or is found to be 

disqualified by Article 3, Article 15 and Article 22 

(3) If the owner has made false reports in fulfilling obligations of Article 13 1 for illegitimate purposes 

3. Registration may be revoked if the owner of a horse has not fulfilled the reporting obligations of Article 13 1 within one year period from the point where changes to report occurred. 

4. Any horse whose registration has been revoked for the reasons specified in 2 may not be re-registered.

5. The CSBC is not liable for any loss resulting from or related to the revocation of registration. 

6. The CSBC may refuse any applications by the owner (at the time of the revocation) of a horse whose registration has been revoked by 2 and 3. 

 

Article 10. (Facts to be registered) 

The facts to be registered include name of the horses, registration date, registration number, sex, color, place and date of foaling, markings, parentage, breeder, name (name of the representative in case of corporate owner) and address of the owners, etc., and the breeding records for breeding- registered horse. 

 

Article 11. (Correction of the registered facts) 

The CSBC shall correct the error and notify the owner of the correction if any error is found in the registered facts. 

 

Article 12. (Public notification of the registered facts) 

1. The horses registered pursuant to these Rules shall be recorded into the Chinese Stud Book, Supplement and other publications. 

2. If any of the following changes affecting the status of a registered horse occurs, it shall be recorded in publications specified in 1. 

  1. (1)  If the registration of a horse has been revoked 

  2. (2)  If the registration of a horse has been corrected or changed 

 

Article 13. (Reporting of changes) 

1. If the registered facts change or any of the following happens, the owner of the horse shall report the changes to the CSBC within 30 days of the change and submit supporting documents. 

(1) If the ownership has been transferred through sale, exchange, donation, inheritance, etc. 

(2) If a horse has been used for purposes other than breeding or racing or has been dead (naturally dead or destroyed) 

(3) If any changes have been applied to the body of a horse such as color, acquired, new brands, markings, etc. 

(4) If a horse has been gelded or spayed 

2. The transfer of ownership shall be reported by the new owner if the transfer is caused by 1 (1), and by the previous owner if by 1 (2).

3. If the reporting of changes are delayed, the owner shall pay the late fee set in Article 38 to the CSBC. 

 

Article 14. (DNA Testing) 

1. Any person applying for the registration of his/her horses shall have the concerned horses DNA tested in accordance with the international standards set by the International Stud Book Committee (ISBC) and the International Society of Animal Genetics (ISAG), and shall pay the testing fee set in Article 38. 

2. Registration inspectors shall identify the horse and take the blood sample for DNA testing (or giving assistance to a veterinarian). 

3. DNA testing shall be carried out by China Agriculture University Equine Blood Test Research Center which is officially designated by CSBC. The result should be reported to CSBC in time. 

4. If the result of the DNA testing raises suspicions about parentage of a horse, it shall be re-DNA tested. Re-typing is allowed only for twice for one application. 

5. The detailed results of the tests should not be revealed to any one but the CSBC or foreign stud book authorities. 

6. If the sire of a foal imported in uterus and born in China has not been imported, or the dam or the sire has been dead before DNA tested, the results of the DNA testing by the laboratory designated by the stud book authority of its foaling or exporting country shall be requested. 

 

Chapter 3 Foal Registration 

Article 15. (Eligibility) 

A foal born in China, which satisfies any of the following, is eligible for Foal Registration. 1. Any foal produced between breeding-registered sire and dam in China.
2. Any foal imported in uterus with documents specified in Article 16 1 (2). 

 

Article 16. (Application documents) 

1. Anyone (the owner of the eligible horse) who wishes to apply for Foal Registration of his/her horse must submit all of the following documents and the registration fee set in Article 38 within the period specified in 2. 

(1) Chinese-bred foals conceived and dropped in China 

  1. 1)  Foal Registration Application 

  2. 2)  Covering Certificate 

(2) Foals imported in uterus 

  1. 1)  Foal Registration Application 

  2. 2)  A certificate issued by foreign stud book authority verifying the covering

2. The Foal Registration Application should be submitted within 60 days from the foaling date of the foal. Even in delayed submission, the application must be made by December 31 of the foaling year (for foals conceived in Southern Hemisphere, July 31 of the following year). 

3. The covering certificates sent by the foreign stud book authority directly to the CSBC will be considered to be submitted by the applicant. 

4. The CSBC shall have the right, when deemed necessary, to require that additional documents to take blood and other samples from a foal, and to mark on its body for identification. 

5. Every registered foal will be issued a passport. 

 

Article 17. (Brand) 

1. At the time of blood sampling and description by a veterinarian or a registration inspector the brands are present as permanent, acquired markings. 

2. A horse that has been incorrectly or indistinctly branded must never be rebranded over the site of the existing brand. The breeder should consult the CSBC before attempting to rebrand the horse. 

3. Any horse whose brand does not correspond in detail with the brand description prepared by CSBC must be re-DNA tested and reidentified. 

4. The brand cannot be changed without permission of CSBC. 

 

Article 18. (Inspection for Foal Registration) 

For foals whose Foal Registration Application is made, all the following inspections shall be carried out by the registration inspectors certified by CSBC. 

1. Preparation of Identification Slip by recording the sex, color, and markings of the horse (brand, white hair, whorl, etc.). 

2. Confirming Inspection of the sex, color, and markings (brand, white hair, whorl, etc.) taken by 1 (carried out in the year following birth). 

3. Parentage verification (by DNA testing and applying the principles of coat-color inheritance). 

4. Any kind of additional inspection as deemed necessary. 

 

Chapter 4 Naming Registration 

Article 19. (Naming) 

1. Chinese-bred horses may be named only if they are one year old or older and foal- registered. The registration of a name for a horse can only be made by or with approval of the competent Authority of its country of birth. For a horse born abroad, the application to register a name must be made through the relevant authority of country where the export certificate is lodged. Names of foreign-bred horses are, in principle, given by the competent authorities of the foaling countries, and the phonetic translation into Chinese name given

before the importation shall not exceed 6 letters without spaces. In this case, the prior approval from the competent authority of the foaling country is required. 

2. The owner who is to name his/her horse must submit a Naming Application including the proposed names to the CSBC and the registration fee set in Article 38. 

3. Concerning names registered and not protected, the following criteria for stallion, broodmare and other horses are provided as a guideline forming the basis upon which Authorities may establish a suitable period during which registered names will not be reused. Names already given to a horse are not available for use before the periods specified below expire. 

(1) Broodmare: 10 years after their death or 10 years after the last recorded year in which they were covered or produced a foal, or at 25 years of age(whichever is the soonest). 

(2) Stallion: 15 years after death or 15 years after the last recorded year in which they covered mares or at 35 years of age(whichever is the soonest). 

(3) Others: 5 years after their death, or at 20 years of age(whichever is the soonest). An exception may be made where the name of a horse which has been reported as dead and has not raced is sought for re-use by the same applicant. 

4. Names given by 1, if in Chinese, must consist of no more than 6 letters without spaces between letters. Name in English, no more than 18 characters, with spaces included. 

5. An International List of Protected Names is maintained and published by the International Federation according to the Rules adopted by the Executive Council. The List covers the names of certain horses whose fame derives from their accomplishments on the racecourse or at stud. The Rules governing inclusion on this List are set out under Appendix 9. 

6. Alphabetized names must be accompanied by a suffix showing the foaling country in the parentheses. 

 

Article 20. (Non-eligible Names) 

Names cannot be accepted if they are already registered subject to the conditions on re-use of names set out above, nor if: 

  1. (1)  they appear on the International List of Protected Names. 

  2. (2)  they have more than eighteen characters, including signs or spaces. 

  3. (3)  they are the name of a public person, without that person’s or their family’s 

permission, or names of commercial significationce without the appropriate permission. 

  1. (4)  they are followed by numbers. 

  2. (5)  they are made up entirely of initials or include figures, hyphens, full stops, commas, 

signs, exclamation marks, inverted commas, forward or back slash, colon and semi-colon. 

(6) they are suggestive or have a vulgar, obscene or insulting meaning; names considered in poor taste; or names that may be offensive to religious, political or ethnic groups. 

(7) in pronunciation, they are identical or similar to a protected name or a name registered for a horse whose year of foaling is within ten years of that of the horse in question. 

(8) they start with a sign other than a letter.

(9) they are already registered to a sibling or parent of the horse in question. 

 

Article 21. (Change of names) 

1. Names already given to a horse cannot be changed. Nevertheless, in the cases judged to be unavoidable, names may be changed once before the horse runs its first race (including races abroad). 

2. In spite of 1, when judged that a name already given to a horse can cause a clear disruption in registration or race operation, that name can be changed once by the CSBC with no concern of whether the horse has run or not. 

3. Any owner, who is to change the name of his/her horse according to 1, must submit the Name Change Form to CSBC along with the fee set in Article 38. 

4. For the name changes of foreign-bred horses pursuant to 1 or 2, prior approval from the competent authorities of the foaling countries will need to be obtained. 

 

Chapter 5 Breeding Registration 

Article 22. (Eligibility) 

Only horses with registered names and breeding purpose are eligible for breeding registration when the following requirements are met. 

1. Horses foal-registered (foreign-bred horses registered with the stud book authorities of the foaling countries) 

2. Horses older than 36 months 

 

Article 23. (Application documents) 

1. Anyone who is to apply for the Breeding Registration of his/her horses must submit all of the following documents and the registration fee set in Article 38 within the period by Article 24. 

  1. (1)  A Breeding Registration Application 

  2. (2)  Passport 

2. The CSBC shall have the right to require that additional document when it deems necessary for registration. 

 

Article 24. (Submission period) 

1. The application submission periods for Breeding Registration are as follows. 

(1) Racehorses: Within 45 days from the date of termination of its Racehorse Registration 

  1. (2)  Imported horses: Within 45 days from the date of import 

  2. (3)  Others: 30 days before the anticipated date of its first covering 

2. If an application is submitted after the period set in 1, the owner must pay the fee set in Article 38.

Article 25. (Inspection for Breeding Registration) 

For horses whose Breeding Registration Application is made, all the following inspections shall be carried out by the registration inspectors certified by CSBC. 

1. Screening of documents submitted 2. Identification of the horse
3. Verification of DNA testing results 4. Others deemed to be necessary 

 

Chapter 6 The management of breeding records 

Article 26. (Issuance of a Covering certificate) 

The owner of a breeding-registered stallion shall issue to the broodmare owner a Covering Certificate including information on the broodmare covered, the first and last dates of coverings, and declarations that artificial methods such as artificial insemination have not been used and the identity of the broodmare has been checked against the identification documents. 

 

Article 27. (Reporting of covering and breeding records) 

1. The owner of a breeding registered horse must report to the CSBC on all covering and breeding records on an annual basis in the manner described below. 

(1) The owner of a stallion submits the Stallion Report that includes all the coverings by the stallion by September 30 of that year. 

(2) The owner of a broodmare shall submit the Return of Mares which includes all the breeding records (including records of foals alive, the reasons for no foal, etc.) by July 31 of that year (for the foals conceived in the southern hemisphere, the due date is December 31 of that year). 

2. The owner of a breeding horse must pay the fee set in Article 38 in case that reporting is made after the due date set in 1, and, in principle, if the reporting is not made within 1 year from the due date, the foals born as the results of the coverings after that point may not be foal registered or entered into the Chinese Stud Book. 

 

Article 28.(Registration of breeding records into the Chinese Stud Book) 

The Information reported by the owner or breeder and confirmed by the CSBC shall be registered in the Chinese Stud Book. 

 

Chapter 7 Import 

Article 29. (Recording of imported horses) 

An imported horse shall be entered into the official records or the Chinese Stud Book according to these Rules only with official documents with international validity which were issued by the stud book authority of the exporting country. In this case, the horse must be registered previously with the stud book authority of the foaling country.

Article 30. (Application for Recording) 

1. Anyone who applies to record imported horses shall submit all of the following documents and the appropriate fee set in Article 38. 

(1) The Application for Recording of Importation (A Breeding Registration Application for Breeding Registration) 

(2) A Certificate of Exportation issued by a foreign stud book authority; or documents which have the same effect 

(3) Passport 

2. The certificates and documents of 1 (2) sent by the foreign stud book authority directly to the CSBC will be considered to be submitted by the owner of the imported horses. 

3. The CSBC shall have the right to require that additional document when it deems necessary for Recording. 

 

Article 31. (Inspection of imported horses) 

1. For horses whose Recording of the Imported Horse application is made, all the following inspections shall be carried out by the registration inspectors certified by CSBC. 

  1. (1)  Identification of the horses with the documents required by Article 30 1 (2) or (3) 

  2. (2)  Others deemed to be necessary 

2. The CSBC shall notify the stud book authority of exporting country of the inconsistency found in the inspection of 1 (1). 

 

Chapter 8 Export 

Article 32. (Issuance of the Certificate of Exportation, etc.) 

1. Anyone who is to export a horse shall submit all of the documents required below and the appropriate fee set in Article 38, and the CSBC shall issue a Certificate of Exportation for the exported horse. 

  1. (1)  An application form for the Certificate of Exportation 

  2. (2)  A certificate for the horse issued by Article 36 

  3. (3)  A Covering Certificate in case of a broodmare in foal 

  4. (4)  Passport 

2. The CSBC shall take additional inspection procedures to check the identity of the horse and to correctly prepare the Certificate of Exportation. 

3. Certificate of Exportation is for permanent export. In case of temporary export (within 9 months) only the endorsement of passport is required. 

4. The CSBC shall mail the Certificate of Exportation directly to the authority of the importing country.

Article 33. (Endorsement of passport) 

The passport of the horse being exported must be submitted to the CSBC for endorsement prior to the exportation. 

 

Chapter 9 Publications of the Chinese Stud Book

Article 34. (Publication of the Chinese Stud Book and etc.) 

The CSBC shall publish a Stud Book every four years and a supplement every year. 

 

Chapter 10 Issuance of certificates, passport and others 

Article 35. (Issuance of passport) 

1. The CSBC may issue passport for identification of Chinese-bred horses or for other purposes. 

2. The owner of a horse with a passport shall report to the CSBC any changes of information contained in the passport and acquire the confirmation on the correction of the changes within 30 days from the occurring date of those changes. 

 

Article 36. (Issuance of certificates) 

The CSBC shall issue one of the following certificates to the owner of a registered horse. 

1. A Certificate of Foal Registration for a Chinese-bred horse that has been foal- registered 

2. A Certificate of Imported Horse for a foreign-bred horse (except for breeding- registered horses) 

3. A Certificate of Breeding Registration for a Breeding-registered horse 

 

Article 37. (Re-issuance of certificates and passport) 

1. The owner of a horse whose certificates or passport were misplaced or severely defaced may apply for the re-issuance of the certificates or passport. 

2. The owner shall pay the re-issuance fee set in Article 38 and submit a re-issuance application of the certificates or passport when he/she applies for re-issuance pursuant to 1. 

3. The CSBC may request the applicant to explain reasons for the application by submitting documentary evidence or by being present in person to explain the reasons for re- issuance. 

4. When a certificate or passport is re-issued pursuant to 1, the fact that it has been re- issued shall be stated in the new certificate or passport. In this case, the certificate or passport issued previously becomes invalid. 

5. After the owner applies for re-issuance and pays the re-issuance fee, the refund will not be admissable.

Article 38. (Fees) 

Fees required by these Rules are as attached in a Separate Table. 

 

Article 39. (Identification Documents) 

1. The owner of a registered horse shall confirm the identity based on the identification documents (certificates or passport) issued by the CSBC before covering, sale or transfer. 

2. In the case of ownership transfer, after reporting to CSBC for the record, the new owner should take over the identification documents, which is signed by the former owner. 

 

Article 40. (Rules for operation) 

Detailed items necessary to enforce these Rules shall be decided separately by the CSBC. 

 

Article 41. (Right to interpret) 

The right to interpret of the rules belongs to CSBC separately.
